Terms of Service

These Terms govern use of https://healthai.coach, the HealthAI membership, the member desk, and related SMS, email, and phone services. HealthAI is a product of Henry Software LLC(“we,” “us”). By buying, signing in, or using the site you agree to these Terms and to our Privacy Policy.
The service
HealthAI provides educational coaching in athletic performance, health, and general wellness through an assigned AI coach (currently Catherine Flockhart, AI running coach): a secure health portal with a written plan and written coaching, optional text messages, and optional calls. It is coaching and education. It is not medical care, diagnosis, physical therapy, or emergency service. If you have chest pain, fainting, or another urgent symptom, call emergency services. We may refuse or stop programming when safety flags are on the file and refer you to a clinician.
Eligibility
You must be at least 13 years old to use HealthAI. If you are 18 or older, you may sign up yourself. If you are 13 to 17, you may use HealthAI only with the consent of a parent or legal guardian, who gives their name and email at signup, agrees to these Terms on your behalf, and is responsible for your membership. We email that parent or guardian a confirmation with a link to manage or cancel. HealthAI does not knowingly create accounts for children under 13; if we learn that a child under 13 has signed up, we close the account and delete the information. For members under 18, Catherine does not discuss weight loss, body composition, or restricting food, refers any pain or injury to a parent and a doctor, and calls only between 7am and 9pm local time. By using the service you confirm the date of birth you gave is true.
Membership and payment
Memberships are billed monthly in US dollars by Stripe until you cancel: Data is $30a month and Accountability is $200 a month. When a free trial is offered, it lasts 2 days, your card is collected at signup, and the first monthly charge happens when the trial ends unless you cancel before then in billing. Each person may have one free trial. You can cancel at any time in billing; cancelling stops the next charge, and access lasts while the membership is current. Failed payment may pause the desk, texts, and calls. Taxes may apply. Extra call minutes may be billed only if your use that month sits above the 90th percentile of HealthAI.coach users, as described on the site.
Accounts
After payment we email a receipt and an activate link so you can set a password. You are responsible for that login. The member file is yours. The plan is the work. Do not share your password.
SMS program (HealthAI / Catherine Flockhart)
HealthAI SMS is an optional program. If you opt in on our text sign-up page, we may text you training notes, replies to your texts, payment receipts, a desk activate link, and account updates about your paid coaching membership. Program name: HealthAI. Sender:Henry Software LLC doing business as HealthAI / Catherine Flockhart.
Message frequency: about three messages per day. Message frequency varies. Message and data rates may apply. If you have questions about your text or data plan, contact your wireless provider. Carriers are not liable for delayed or undelivered messages.
You can cancel the SMS service at any time. Text STOP to opt out. After you text STOP you will receive a confirmation message and no further messages will be sent. For help, text HELP or email caroline@henry.biz. You may also visit https://healthai.coach/support. Text START, YES, or UNSTOP to opt back in.
Consent to receive SMS is not a condition of purchase and is not required to buy HealthAI or to use the health portal or phone coaching. The only way to opt in is the separate checkbox, unchecked by default, on our public text sign-up page at https://healthai.coach/text. We do not collect SMS consent at checkout, during onboarding, in the health portal, or on calls. A phone number you give us for coaching calls or for your account is never used for text messages unless you opt in on that page.
Privacy of SMS and mobile numbers is described in our Privacy Policy: https://healthai.coach/privacy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Calls
Paying members may call the published HealthAI coaching line while the membership is current. Unpaid months do not include that line. Calls are coaching, not a medical visit.
Acceptable use
Do not misuse the desk, harass, attempt to break in, scrape, resell the service, or upload others’ private data. We may suspend an account that breaks these Terms or the law.
Intellectual property
HealthAI, the site, and coach materials are owned by Henry Software LLC. Your uploaded logs, labs, and notes remain yours. You grant us a license to use them only to coach you and operate the service.
Disclaimers
The service is provided as is. We do not warrant uninterrupted texts, calls, or uptime. Training has risk. You train at your own risk. Educational coaching only. Not medical advice.
Limitation of liability
To the fullest extent allowed by law, Henry Software LLC is not liable for indirect, incidental, or consequential damages, or for amounts beyond fees you paid us in the three months before the claim.
Governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Courts in Wisconsin have exclusive venue, except where the law requires otherwise.
Changes
We may update these Terms. The date at the top will change. Continued use after an update means you accept the new Terms.
